A Lei Geral de Proteção de Dados Pessoais (LGPD) tem uma seção específica para o tratamento de dados pessoais de crianças e adolescentes, explicitando que tal processo, especificamente para estes titulares, deverá ser realizado no melhor interesse destes públicos.
Isso significa que a LGPD exige cuidados específicos quando a atividade da organização envolver o tratamento de dados de menores de idade, sendo que a Lei nº 8.069/1990 (Estatuto da Criança e do Adolescente), em seu art. 2º, considera criança a pessoa até 12 anos de idade incompletos e adolescente aquela entre 12 e 18 anos de idade.
Ocorre que a interpretação de diversos dispositivos dessa lei é objeto de acentuada controvérsia entre acadêmicos, profissionais da área e representantes da sociedade civil. Na prática, esta situação gera forte incerteza jurídica para os agentes de tratamento, em razão da indefinição sobre quais hipóteses legais autorizam o tratamento de dados pessoais de crianças e adolescentes.
Considerando tais divergências e as suas relevantes implicações práticas, a Autoridade Nacional de Proteção de Dados (ANPD) tornou pública a tomada de subsídios para receber contribuições da sociedade, a fim de ouvir os diferentes interessados no tema. Ao considerar os diversos posicionamentos na sua tomada de decisão, preparou estudo preliminar sobre o tema com sugestão inicial da área técnica para elaboração de enunciado sobre a questão.
Neste documento, a ANPD elencou três possibilidades de interpretação para o tratamento de dados deste público:
(i) consentimento dos pais ou responsável legal como única base legal;
(ii) aplicação do art. 11 da LGPD, equiparando os dados de crianças e adolescentes a dados pessoais sensíveis;
(iii) aplicação dos arts. 7º e 11 da LGPD, desde que observado o princípio do melhor interesse.
Em cada hipótese interpretativa, a Autoridade discorre sobre os prós e contras da sua aplicação e, no final, apresenta uma proposta de enunciado, conforme previsto no art. 55-J, XX, da LGPD, o qual permite à ANPD, enquanto órgão central de interpretação, a competência para deliberar, na esfera administrativa, em caráter terminativo, sobre a interpretação da lei.
A análise apresentada não representa, necessariamente, a opinião final da ANPD sobre o tema, visto que a tomada de subsídios ficou aberta para contribuições até 7 de outubro no site da Autoridade Nacional.
O estudo preliminar traz boas orientações sobre dados sensíveis e classificação de hipóteses de tratamento, e é um excelente documento para estudo e reflexão das organizações sociais que tratam dados de crianças e adolescentes, sejam como acolhidos ou como beneficiários e dependentes de seus colaboradores.
Entretanto, ao mesmo tempo, não esclarece qual deve ser a adequada utilização e aplicabilidade do termo “melhor interesse”, carregado de subjetividade, gerando incerteza jurídica para os agentes de tratamento que operam os dados pessoais de menores de idade.
Conhecer os direitos desses titulares, suas obrigações como controlador ou operador desses dados e reavaliar seus fluxos e processos internos, para que seu tratamento esteja em conformidade com a LGPD e com as orientações da ANPD, é imprescindível para que sua organização dê continuidade e segurança ao seu negócio e aos titulares dos dados.
