As horas extras ficam incorporadas ao salário?
Caro/a leitor/a, a incorporação das horas extras ao salário não vigora mais em função do Enunciado 291, do Tribunal Superior do Trabalho, que assim determina: “A supressão, pelo empregador, do serviço suplementar prestado com habitualidade durante pelo menos um ano, assegura ao empregado o direito à indenização correspondente ao valor das horas mensais suprimidas para cada ano ou fração igual ou superior a seis meses de prestação de serviço acima da jornada normal. O cálculo observará a média das horas suplementares efetivamente trabalhadas nos últimos 12 meses, multiplicado pelo valor da hora extra do dia da supressão”. Assim, em tese, não é necessário homologar tal ato perante o sindicato ou delegacia do trabalho.
